User agreement
This User Agreement (hereinafter the "Agreement") is concluded between you (hereinafter the "User") and LA GELATERIA LIMITED LIABILITY COMPANY (hereinafter La Gelateria LLC) and regulates all types of use of the La Gelateria Italiana Website (hereinafter the "Website"), which is owned and managed by La Gelateria LLC, services provided by La Gelateria LLC thanks to the Website and all information available in Website.
Basic concepts
App Store, Google Play Market, Microsoft Market - official Internet resources of Apple, Google and Microsoft corporations, respectively, intended for placing Websites in public access.
A Website is an Website installed from Google Play or Apple App Store or Microsoft Market on a client's smartphone, developed and hosted on behalf of La Gelateria LLC
Personal data, data of customers, individuals or legal entities, necessary for "LA GELATERIA" LLC for the supply and sale of goods (ice cream and other products) to customers on the territory of Ukraine, as well as the provision of related services.
General provisions

Personal data of the client of "LA GELATERIA" LLC, such as: name, surname, patronymic, e-mail, telephone, are transferred to "LA GELATERIA" LLC with the consent of the client.
The client provides his personal data by entering them in the appropriate fields in the forms of the Website.
The basis for the client's consent to the transfer of personal data is the installation of the Website and the fulfillment of any request related to the cargo.

The terms of the Agreement apply to all users of the Website - both users who do not have an account in the Website or in the loyalty program (unregistered user), and users who have any account of any of the available types. An account is a set of user information and authorization data (login, password).
The User has no right to use the Website and cannot accept the terms of the Agreement if he has not reached the legal age when he has the right to enter into such agreements.
If the law of the country where the User lives or is located prohibits the use of the Website for any reason, the User must refrain from using the Website, and if he continues to use the Website, he does so at his own risk and under his own responsibility. At the same time, all terms of this Agreement remain in force.

The procedure for using the Website and ordering goods
Rights, duties and responsibilities of the parties
The user agrees not to take actions that may be considered as violating Ukrainian legislation or norms of international law, including in the field of intellectual property, copyright and/or related rights, as well as any actions that lead or may lead to disruption of the normal operation of the Site and the services of the Site.
By using the Website and participating in the loyalty program, the User confirms that he has read and accepted the terms of the program at the address Program Rules.
The User undertakes to properly comply with the terms of this Agreement.
The User has the right to use the Website exclusively for the purpose of personal use in accordance with the terms of this Agreement.
The user undertakes not to use the Website in violation of the rights and legitimate interests of La Gelateria LLC, other rights holders, third parties, and this Agreement.
The user undertakes to take appropriate measures to ensure the safety of his device and bears personal responsibility in case of access to his device by third parties.
The User is prohibited to decompile the Website independently or with the involvement of third parties, as well as reverse-engineer the Website.
The User is personally responsible for using the Website in any way not expressly permitted by this Agreement.
The User has no right to perform any unauthorized actions with the Website.
Before installing the Website on your device, the User must familiarize himself with all the information about the Website, which is posted on the website https://lagelateriaitaliana.ua. Installing the Website on a device confirms the User's fulfillment of the obligation specified in this paragraph. In case of disagreement with the terms of this Agreement, the use of the Website by the User must be stopped immediately.
The user is given the opportunity to download and use the full functionality free of charge.
The User gives consent to "LA GELATERIA" LLC to process his personal data, other data that the User provides to "LA GELATERIA" LLC through their actions, by placing them in the Website, to achieve the goals of the Website's operation.
Rights and obligations of "LA GELATERIA" LLC
"LA GELATERIA" LLC has the right to transfer the rights and obligations under this Agreement to third parties for the purpose of implementing this Agreement without the User's additional consent.
"LA GELATERIA" LLC has the right to send the User information about the operation of the Website and / or loyalty program in any way, including sending advertising, informational and other messages to the e-mail address or phone number specified by the User, or to post relevant information in the Website.
"LA GELATERIA" LLC has the right to provide paid and free services to Users. "LA GELATERIA" LLC informs the User about the conditions for providing paid services by posting information in the Website or on the website https://lagelateriaitaliana.ua
"LA GELATERIA" LLC has the right to block the User's access to the Website or its parts in case of violations of this Agreement by the User.
"LA GELATERIA" LLC has the right to limit, suspend or terminate the use of the Website without prior notice without compensating the User for damages, including if "LA GELATERIA" LLC has data to believe that the User or its affiliates (intentionally or unintentionally):
When using the Website, the Legislation, the provisions of this Agreement or the rights and legitimate interests of third parties are violated;
Damage the Website or its performance;
Make attempts of unauthorized access to the Website and the information contained in it;
They pose a threat of technical and/or software failure of La Gelateria LLC and/or third parties.
"LA GELATERIA" LLC has the right to limit, suspend or terminate the use of the Website at any time without prior notice.
Other conditions
La Gelateria LLC has the right to amend this Agreement. All changes made to the Agreement will be available in the form of a new version of the Agreement. In case of significant changes to the Agreement, La Gelateria LLC will additionally notify the User about these changes using known means of communication. All changes to the Agreement become effective from the moment of their publication. By using the services or the Website, the User confirms his agreement with the new terms of the Agreement in the version valid at the time the User uses the services or the Website.
"LA GELATERIA" LLC is not responsible for damage or losses suffered by the User or third parties as a result of misunderstanding or misunderstanding of the terms of this Agreement, instructions or instructions on the procedure for using the Website, regarding the procedure for posting data and other technical issues.
The user grants La Gelateria LLC the right to send him messages containing information about the Website, services of La Gelateria LLC, or information of an advertising nature.
In the event that any part of this Agreement is declared invalid or unenforceable, the other parts of the Agreement will remain in effect.
The Website is provided by "LA GELATERIA" LLC "as is". "LA GELATERIA" LLC does not guarantee the compliance of the Website with the goals and expectations of the User, its uninterrupted and error-free operation.
"LA GELATERIA" LLC has the right to unilaterally change the cost, types and terms of service provided within the Website.
La Gelateria LLC may assign its rights under this Agreement to a third party at any time and without notice to the User.
The legislation of Ukraine applies to this Agreement and the relationship between La Gelateria LLC and the User arising in connection with the use of the Website. Each party expressly agrees that the relevant courts of Ukraine shall have exclusive jurisdiction over any claims, disputes or disagreements relating to the Agreement and the use of the Website.
Data storage and processing
Measures to protect customer information
Important: The PIN code is used to access bank cards, do not transfer or disclose the PIN code to third parties.
Personal information of the User and other information provided by the User is used by "LA GELATERIA" LLC for the purpose of achieving the goals of using the Website.
After pressing the "CONFIRM" button, the User automatically confirms the correctness of the entered data.
- The client's personal data is stored exclusively on electronic media and databases of "LA GELATERIA" LLC and is used exclusively for the purpose specified in p.a. section 2 of this Privacy Policy.
- Personal data is stored on electronic media and databases of "LA GELATERIA" LLC indefinitely.
-La Gelateria LLC administration takes technical and organizational and legal measures to protect personal data of customers from illegal or accidental access to them, destruction, changes, blocking, copying, distribution, as well as from other illegal actions.
